GENERAL PROVISIONS
1.1. These Rules for the Processing of Personal Data (hereinafter referred to as the Rules) set out the procedure for using the lynukelias.lt website (hereinafter referred to as the lynukelias.lt), as well as the rights, duties, responsibilities and other provisions of the visitors of lynukelias.lt (hereinafter referred to as the Visitors).
1.2. lynukelias.lt is managed and administered by Lynų kelias UAB, located at A. Juozapavičiaus pr. 84, LT-45212 Kaunas.
1.3. Visitors of lynukelias.lt can download videos, PDF books or other content free of carge or for payment on a voluntary basis by entering their contact details. The Visitor also shall have the right to share information about lynukelias.lt’s content on social networks. The Visitor can comment and participate in discussions in all comment sections of the website. The visitor can voluntarily enter his/her contact details to subscribe to the newsletter.
1.4. By reading these Rules and entering his/her contact details, the person consents to lynukelias.lt processing the provided personal contact details for direct marketing purposes. This consent also confirms that personal data for direct marketing purposes may be disclosed to the Author of the specific downloaded content (video, book, text) (hereinafter referred to as the Author) and may be processed by that Author for the same purposes. In this case, the responsibility for the processing of the Data for direct marketing purposes rests with the Author of the content.
1.5. The Data Controller shall have the right to unilaterally modify the content provided on the lynukelias.lt web portal by deleting or editing it. The Data Controller shall also have the right to unilaterally modify any of the provisions of the Rules. If, after changing, correcting or addition of the Rules, the Visitor continues to send the content, this shall mean the Visitor’s acceptance of the changes to the Rules.

DISCLAIMER
2.1. The Data Controller of lynukelias.lt and the Authors shall not be liable for the content of the information published on the lynukelias.lt website, its novelty, accuracy, correctness and consequences that may arise from the use of the information provided on the lynukelias.lt website. The Data Controller shall not be liable for damage caused to the Visitor or third parties due to the content of the Book or other materials. The use of the information on the website is the responsibility of the Visitor. The Author is responsible for the information contained in the work published on lynukelias.lt.
2.2. The Data Controller shall not be liable for any malfunction of the lynukelias.lt database caused by reasons beyond the Data Controller’s control.
2.3. The Visitor is responsible for the correctness of the contact details entered. The Data Controller shall not be liable for any damage suffered by the Visitor as a result of the input of incorrect contact details.

PRIVACY POLICY
3.1. A person wishing and consenting to the processing of his/her personal data by the administration of lynukelias.lt, as defined by the laws of the Republic of Lithuania, must fill in the form fields for contact details after having familiarized himself/herself with the information provided in the Rules and click on the relevant link “Sign Up”, “I want” or similar. By doing so, the person confirms that he/she has provided the correct details and agrees to its processing by the administration of lynukelias.lt.
3.2. By visiting and/or using the lynukelias.lt website, the Visitor confirms that he/she is at least 18 years of age or has the consent of his/her parents or legal guardians/persons responsible for him/her, and is able to fully exercise his/her rights and obligations under these Rules. In any event, the Person confirms that he/she is over 14 years of age, as the lynukelias.lt website is only intended for persons aged 14 and over. Visitors younger than 14 years of age have no right to visit the website lynukelias.lt and/or use the information (data) contained therein.
3.3. By downloading the lynukelias.lt content, the Person agrees to the processing of his/her personal data for direct marketing purposes. The Person shall have the right to withdraw his/her consent at any time by notifying lynukelias.lt administration in writing.
3.4. The Person shall have the right, in accordance with the procedure laid down by law, to:
1) to know (be informed) about the processing of his personal data;
2) to have an access to his personal data and to be informed of how they are processed;
3) request the rectification or destruction of their personal data in the cases set out below;
4) object to the processing of their personal data.
3.5. lynukelias.lt undertakes to enable the person to exercise the rights set out in p. 3.4, except in cases established by laws, when it is necessary to ensure:
1) state security or defense;
2) public order, crime prevention, investigation, detection or prosecution;
3) important economic or financial interests of the State;
4) detection of violations of service or professional ethics;
5) protection of the rights and freedoms of the data subject or other persons.
3.6. lynukelias.lt undertakes to inform the person whose personal data it collects directly from him/her about his/her (the data controller’s) identity and domicile, and that of his/her representative, if any, the purpose for which the personal data are processed and to whom they are provided, where such information is available to the person.
3.7. The administration of lynukelias.lt may collect personal data and process them for own and partners’ direct marketing purposes, and undertakes to enable the Visitors to refuse lynukelias.lt services by discontinuing the processing of their personal data.
3.8. By submitting a personal identity document to the administration of lynukelias.lt, a person shall have the right to receive information on the sources and nature of his/her personal data, the purposes for which they are processed and to whom they are provided.
3.9. If a person believes that his or her personal data is incorrect, incomplete or inaccurate, the person must inform the administration of lynukelias.lt in order to have the data corrected. data is being processed unlawfully or fraudulently and contacts the administration of lynukelias.lt, the administration of lynukelias.lt undertakes to check the lawfulness and integrity of personal data processing free of charge and, at the request of the person, destroy the personal data collected unlawfully and fraudulently.
3.10. Personal data shall be corrected and deleted in accordance with the request (requirement) of the person and the documents confirming his identity and personal data. lynukelias.lt undertakes to inform the data recipients about the personal data corrected or destroyed at the request of the person.
3.11. If a person objects to the processing of his/her personal data, the administration of lynukelias.lt undertakes to immediately terminate the processing of the personal data, except in the cases provided for by law, and to inform the recipients of data.
3.12. At the request of a person, the administration of lynukelias.lt undertakes to notify a person of the termination of the processing of his/her personal data or refusal to terminate the processing of his/her data. At the request of a person, the administration of lynukelias.lt undertakes to retain all terminated personal data for processing.
3.13. To improve the services, lynukelias.lt may collect certain technical information about the Visitors (IP addresses, data about browsers used, operating systems, computer settings, etc.), but may use it only for statistical analysis. For some services (tailored content), the use of “cookies” is necessary.

COPYRIGHT
4.1. The copyright in the information provided to lynukelias.lt belongs to the respective natural and legal persons as indicated next to the text, image, sound or other information. When quoting textual information, authorship must be indicated. For the publication and other use of video and audio information or the whole specific recording, it is mandatory to consult each of the Authors separately.
4.2. The Data Controller of lynukelias.lt shall not be liable for the unlawful conduct of Visitors in distributing, destroying, distorting or otherwise unlawfully influencing the content uploaded by Authors.
Intellectual property rights
5.1. The Data Controller is the owner of all rights to the lynukelias.lt content or has the exclusive right to use them. All designs, names, logos, etc. of the content hosted on lynukelias.lt are the property of the Data Controller or the Data Controller shall have the right to use them.
5.2. Any processing, copying and (or) other use of lynukelias.lt content, design by third parties without the written permission of the Data Controller and (or) without complying with the Rules, shall constitute an infringement of copyright and other rights, punishable under the laws of the Republic of Lithuania.
Personal data protection
6.1. The Data Controller shall have the right to process and manage personal data provided by the Visitor or collected by the Data Controller in other ways (hereinafter the “Personal Data”) at the time of submission of the personal data or subsequently through the use of the website, in accordance with the procedures and for the purposes set out in these Rules. The Data Controller shall ensure the rights of data subjects in accordance with the Law on Legal Protection of Personal Data and other regulatory acts governing the processing of personal data.
6.2. Personal data shall be processed in order to provide appropriate services to Visitors (to provide access to videos, selected PDF books or other content by email, to provide information about news, etc.). Visitor data is also processed for the purposes of direct marketing and promotional campaigns (direct marketing games, quizzes, competitions). The Data Controller will collect and store Personal Data electronically and will provide extracts of such Personal Data in other forms as necessary.
6.3. Visitors must provide their name, email address, telephone number and city to the lynukelias.lt. This Personal Data is obtained directly from the Visitor.
6.4. By accepting these Rules and providing Personal Data, the Visitor:
6.4.1. entitles the Data Controller to manage and process the Visitor’s Personal Data to the extent and for the purposes set out in these Rules. The Visitor shall have the right to revoke his/her consent to the Data Controller to manage and process the Visitor’s Personal Data at any time, to request the termination of the processing and management of his/her Personal Data, and to delete Personal Data. The revocation of the management and processing of the Visitor’s Personal Data is not retroactive;
6.4.2. declares that he/she provides his/her Personal Data for placement in the website database of his/her own free will and agrees that the data provided by him/her shall be stored and processed electronically in the website database for at least 2 (two) years from the last time he/she provided his/her data to the system;
6.4.3. The Visitor confirms that the Personal Data provided by him/her on the lynukelias.lt website is accurate, complete and correct.
6.5. When processing Personal Data, the Data Controller shall:
6.5.1. use Personal Data for the provision of the Services, for the development and personalization of the lynukelias.lt website and/or other Services of Tinkamiausi Sprendimai UAB, as well as for the submission of proposals on the Services, improvements to the lynukelias.lt functionality, and submission of direct marketing offers;
6.5.2. will not provide Personal Data to third parties and will not make it public, except in the cases specified in the Rules or in legal acts;
6.5.3. The Visitor, having submitted a personal identity document to the Data Controller or in accordance with the procedure established by legal acts or by electronic means that allow for proper identification of the person, having confirmed his/her identity, shall have the right to access his/her Personal Data and the way they are processed; request the destruction of own Personal Data or suspension, with the exception of storage, the processing of own Personal Data where the data is processed in violation of the provisions of the law; object to the further processing of own Personal Data. The Visitor must make all requests to the Data Controller relating to the protection of the Visitor’s Personal Data in writing (including a notification to the general or customer service department by e-mail indicated in the contacts of the lynukelias.lt website). The Data Controller will endeavor to provide answers to such Visitor’s inquiries as soon as possible, but no later than within 30 (thirty) days from the date
of receipt of the inquiry and all necessary documents from the Visitor. The answers shall be in a form acceptable to the Visitor. The answers shall be provided free of charge to the Visitor 1 (one) time per calendar year. The Data Controller will not provide personal data if the Visitor fails to confirm his/her identity, if the Visitor requests data about another person, as well as in other cases provided for by law limiting the disclosure of data to the Visitor. 6.5.4. The Visitor agrees that by submitting his/her contact details on the dedicated platform, the system may record the IP address of the Visitor’s computer and the date and time of access to the system. 6.5.5. By accepting these Rules, the Visitor confirms that he/she grants the Data Controller the right to send the Visitor commercial offers and informational messages of the services of the Data Controller’s company. He also confirms that its data may be processed by the Author of specific downloaded content for the same purposes. In this case, the responsibility for data security rests with the Author of the specific content for which personal contact details were provided for downloading. The Visitor shall have the right to refuse to receive such offers by informing the Data Controller in the manner specified in the notifications and/or offers received. 6.5.6. The Data Controller processes the Visitor’s Personal Data for direct marketing purposes: name, email address, phone number when organizing games, promotions, the Data Controller may process data confirming the fulfilment of the conditions necessary for participation in such a game, promotional campaign, as far as participation in a promotional campaign or the right to participate in a game is concerned. 6.6. The processing of Visitor data for direct marketing purposes is subject to the following rules:
6.6.1. The Visitor’s data is stored on the lynukelias.lt database for a maximum of 2 (two) years from the date of the Visitor’s last login to the account. Upon expiry of this period, the Personal Data shall be destroyed by a person authorized by the Data Controller;
6.6.2. For the purpose of conducting promotional campaigns (direct marketing games, quizzes, contests), Personal Data shall be processed for a maximum of 1 (one) year after the announcement of the results of the promotional campaign and the winners. Upon expiry of this period, the Personal Data shall be destroyed by a person authorized by the Data Controller;
6.6.3. The Data Controller obtains consent for direct marketing: directly from Visitors, after they have explicitly expressed their will (consent) to receive direct marketing offers from lynukelias.lt by filling in the fields for newsletter subscription, and from Visitors who have not objected to the processing of Personal Data at the time of collection
6.6.4. The Data Controller may combine the information available about the Visitor with information held by third parties in order to be able to provide the Visitor with interesting offers, as well as to offer new Services that may be relevant to the Visitor.
6.6.5. By granting the right to process data for direct marketing purposes, the Visitor also grants permission to contact him/her by phone, SMS, e-mail, newsletters with direct marketing offers. The Data Controller shall endeavor to send information and offers of interest to the Visitor.
6.6.6. Upon receipt of personal contact details (name, e-mail address) from the Visitors, the Data Controller may, in accordance with the procedure established by legal acts, use such data without a separate consent of the Data Subject only for the marketing of its own similar goods or services, giving the Visitor a clear, free and easily enforceable opportunity to object to or refuse such use of the data for the purposes specified above, provided that the Visitor did not initially object to such use of the data for each offer.
6.6.7. The Visitor shall have the right to object to the processing of his/her Personal Data for direct marketing purposes, without giving reasons for the objection. The Visitor shall have the right to refuse to receive such offers by informing the Data Controller in the manner indicated in the notifications and/or offers received, or by informing the Data Controller of his/her disagreement by e-mail info@lynukelias.lt or by calling the telephone number indicated in the Data Controller’s contacts. The Data Controller will endeavor to cease processing the Visitor’s data for the purpose of direct marketing as soon as possible, but no later than within 5 (five) business days.
6.6.8. If the Visitor submits data about himself/herself via a social network or other online service (Facebook, etc.), the Visitor understands and agrees that he/she may also receive offers from the Data Controller via the provided contact telephone number and email. He may refuse offers in accordance with the procedure set out in the Rules.

COOKIE POLICY
7.1. In order to function properly, the lynukelias.lt website may store small data files called cookies on the Visitor’s device. Cookies are small pieces of information that are stored on a Visitor’s web browser, computer or mobile device. They help the Data Controller to recognize the Visitor as a previous visitor to the website, to store the Visitor’s browsing history, preferences (such as name, language, font size and other display options) and to customize content. Cookies are a common practice in web browsing that facilitate the Visitor’s navigation on a website already visited and simplify access to the information published.
7.2. The Data Controller uses cookies to determine the Visitors’ habits when browsing lynukelias.lt, to improve the Visitors’ experience when browsing lynukelias.lt, and to provide personalized services to Visitors. Cookie information may include data about the visitor’s use of the lynukelias.lt website, the IP address of the Visitor’s computer, the type of browser, demographic data and, if the Visitor has accessed lynukelias.lt from a third-party website, the URL link of the website. Cookies enable a website to operate more efficiently and improve its services, and to provide information to the website administrators for statistical or advertising purposes.
7.3. The information obtained through cookies is used by the Data Controller for: remembering the contact information entered; ensuring the security of data once it has been entered; ensuring the consistent functioning of the website; remembering the searches used by the Visitor, monitoring the Visitor’s habits in order to provide content that is relevant to the Visitor and improving the portal in accordance with the Visitor’s preferences, for the development of the Services and for targeted marketing orientation.
7.4. The lynukelias.lt website may use the following types of cookies:
7.4.1. Technical cookies – necessary for the Visitor to be able to navigate lynukelias.lt and use the website’s features. Without these cookies, the Visitor would not be able to use the services of lynukelias.lt;
7.4.2. Functional cookies – allow lynukelias.lt to remember the things chosen by the Visitor (such as the contact details) and to offer improved, personalized features to the Visitor. Functional cookies are not essential, but they improve the quality of navigation and the Visitor experience;
7.4.3. Analytical cookies – used for statistical analysis of the navigation methods of website visitors. The Data Controller shall use the results obtained from these cookies anonymously and exclusively for statistical purposes only.
7.4.4. Social cookies are necessary to use lynukelias.lt information in the social profile account (for example, to share a link to download content with friends or for Likes). Cookies from social networks do not affect the navigation of lynukelias.lt.
7.4.5. The Visitor consents to the use of cookies: (i) the first time when performing the content download function, after having read the “Rules for the processing of personal data” on lynukelias.lt, (ii) if the Visitor’s browser accepts cookies, without deleting and/or modifying them; (iii) the Visitor’s consent to the use of cookies on the lynukelias.lt website, contact submission platform is valid for 1 (one) year.
7.4.6. The Visitor can withdraw consent to the use of cookies by changing the browser data and settings (deleting cookies, choosing anonymous browsing, etc.). In order to remove cookies from a mobile phone or other mobile device, the Visitor must follow the instructions for use of the mobile device or the software on the mobile device. However, in some cases, disabling cookies, not accepting cookies or deleting cookies may slow down the internet browsing speed, limit the functionality of certain websites or block access to the website. If the Visitor deletes the cookies, he/she will have to re-enter his/her contact details in writing each time he/she visits lynukelias.lt. 7.4.7. The Data Controller may, without prejudice to the law, combine information obtained through the use of cookies with information obtained about an individual by other means, such as information about the use of services.
7.4.8. Third parties may collect both anonymous and personal information about the Visitor for advertising purposes by means of cookies, and may use both session cookies and persistent cookies. For more information on third party cookies, the Visitor can consult the privacy policy of the third party in question. The Data Controller does not control the activities of third parties and is not responsible for the accuracy, updating, completeness and compliance of third-party information with the legislation. The Visitor must independently check the cookies used by third parties and the information they collect. The Visitor may remove third-party cookies in accordance with instructions provided by third parties.

INFORMATION SECURITY MEASURES
8.1. The Data Controller shall implement the necessary organizational and technical security measures for the processing of the Visitor’s Personal Data to protect it from accidental or unlawful destruction, alteration, disclosure, as well as from any other unlawful processing. The security activities carried out by the Data Controller include, inter alia, the protection of personnel, information, IT infrastructure, internal and public networks, as well as office buildings and technical installations.
8.2. The numbers of payment documents (cards, etc.) used to pay for the Paid Services shall be specially encrypted when such information is sent over the Internet.
8.3. The Data Controller reminds that the Visitor is responsible for the confidentiality of Personal Data. The Data Controller requests caution in the provision of Personal Data. The Visitor should log out of the browser after finishing the work in order to make sure that no one accesses the Visitor’s e-mail, personal information, especially in cases where the Visitor uses a public computer (e.g. in an Internet café, library).
8.4. The Data Controller undertakes to endeavor to protect the Personal Data of the Visitor that it processes, but given that the Visitor’s information is sent via the Internet, the Data Controller warns that the Data Controller cannot and does not guarantee the complete security of the information transmitted by the Visitor, including Personal Data.
8.5. The Data Controller shall keep the Visitor’s Personal Data for as long as is necessary for the implementation of the Rules and the stated purposes. The Customer’s data shall be destroyed after a maximum of 2 (two) years from the date of his last submission. The Data Controller shall endeavor not to keep outdated and irrelevant Personal Data of the Visitor. Historical information is stored if it is necessary for the purposes of the law or for the performance of the Data Controller’s activities (e.g. historical information on the Visitor’s payments, etc.).
8.6. Correspondence with the Visitor shall be stored for no longer than 1 (one) year from the date of the last correspondence. The data shall be stored for the purpose of direct marketing for no longer than 2 (two) years from the last date on which the data was provided by the Visitor, unless a longer retention period is required or permitted by law.

APPLICABLE LAW AND DISPUTE POLICY
9.1. The operation of the lynukelias.lt website is governed by the laws of the Republic of Lithuania. Any disputes arising out of or in connection with the operation of the lynukelias.lt website shall be settled by negotiation or, in the event of failure to reach an agreement, by the competent court of the Republic of Lithuania in accordance with the laws of the Republic of Lithuania and other legal acts.

FINAL PROVISIONS
10.1. The Rules will come into force from the moment the Visitor becomes aware of them and confirms his/her acceptance by entering the contact details, and will remain in force for the entire duration of the relationship between the Visitor and the Data Controller.
10.2. The Company shall have the right to modify the Rules by notifying the Visitor by posting a message thereof on its website.
10.3. Additions or amendments to the Rules shall enter into force from the date of their publication, i.e. from the date on which they are posted on the website.
